TERMS AND CONDITIONS – FOOTIEPREDICTIONS

These Terms and Conditions (“Terms”) govern the purchase of, access to, and use of the services provided by Footiepredictions V.O.F.

By purchasing, accessing, or using our Services, you acknowledge that you have read and understood these Terms and agree to be bound by them.

Nothing in these Terms excludes or limits any rights that cannot lawfully be excluded or limited under applicable mandatory law.

1. DEFINITIONS

1.1. Company

“Footiepredictions”, “Company”, “we”, “us” or “our” means Footiepredictions V.O.F., a general partnership (vennootschap onder firma) established under the laws of the Netherlands.

1.2. Customer

“Customer”, “Member”, “User”, “you” or “your” means any natural or legal person purchasing, accessing, receiving, or using any Service offered by Footiepredictions.

1.3. Services

“Services” means informational sports analysis, statistical analysis, sports predictions, speculative betting tips, betting-related commentary, educational or entertainment content, membership access, and related digital content provided by Footiepredictions.

Services may be delivered through our website, Telegram, Instagram, email, private groups, web portals, or other digital communication channels selected by Footiepredictions.

1.4. Membership

“Membership” means any paid arrangement providing the Customer with access to some or all of the Services for a specified period or under the conditions stated at the time of purchase.

1.5. Agreement

“Agreement” means the contractual relationship between Footiepredictions and the Customer arising from the purchase or provision of a Service and incorporating these Terms.

1.6. Bookmaker

“Bookmaker” means any third-party gambling operator, sportsbook, betting exchange, casino, or similar third-party service.

2. NATURE OF THE SERVICES

2.1. Information and Entertainment

Footiepredictions provides sports-related information, analysis, statistics, opinions, predictions, and entertainment content.

Our Services are not financial, investment, tax, legal, or professional gambling advice.

2.2. No Guaranteed Results

Sports events and betting markets are inherently uncertain.

Footiepredictions does not guarantee:

• that any prediction or betting tip will be successful;

• any particular win rate;

• any level of profit or return;

• the accuracy or continued availability of quoted odds;

• the availability of any particular betting market;

• that historical results will be repeated;

• that a Customer will make money from using the Services.

Past performance is not indicative or a guarantee of future results.

2.3. Analytical Opinions

Predictions, selections and statements concerning possible sporting outcomes represent analytical opinions based on information available at the relevant time.

They should not be interpreted as statements of fact or guarantees concerning future events.

2.4. Customer Decisions

The Customer remains solely responsible for deciding whether to use any information supplied by Footiepredictions and whether to place any wager.

Footiepredictions does not make betting decisions on behalf of Customers.

3. FOOTIEPREDICTIONS IS NOT A BOOKMAKER

3.1.

Footiepredictions is an independent sports analysis and informational service.

We do not:

• accept bets or wagers;

• hold betting stakes on behalf of Customers;

• operate betting accounts for Customers;

• place bets on behalf of Customers;

• determine bookmaker settlements;

• guarantee access to bookmakers;

• guarantee the acceptance of any wager by a bookmaker.

3.2.

Unless expressly stated otherwise, references to a Bookmaker do not imply sponsorship, partnership, endorsement, agency, or affiliation between Footiepredictions and that Bookmaker.

3.3.

Any betting transaction is entered into directly between the Customer and the relevant Bookmaker and is subject to that Bookmaker’s own terms and conditions.

4. ELIGIBILITY AND AGE REQUIREMENTS

4.1.

Customers must be at least eighteen (18) years old.

Where the legal age for gambling or access to betting-related services in the Customer’s jurisdiction is higher than eighteen (18), the higher minimum age applies.

4.2.

By purchasing or using the Services, the Customer represents that they satisfy the applicable age requirement.

4.3.

Footiepredictions may refuse or terminate access where we reasonably believe that a Customer does not meet the applicable age requirement.

5. INTERNATIONAL CUSTOMERS AND LOCAL LAWS

5.1.

Footiepredictions may make its Services available to Customers in multiple countries.

Availability of our Services does not constitute a representation that sports betting or betting-related content is lawful in every jurisdiction.

5.2.

Laws concerning sports betting, gambling advertising, betting-related information and online services differ between jurisdictions.

Customers are responsible for determining whether their use of the Services and any subsequent betting activity is lawful in their jurisdiction.

5.3.

Customers must comply with all applicable local laws, regulations, age restrictions and Bookmaker requirements.

5.4.

Footiepredictions may restrict or discontinue the availability of its Services in any country or territory where reasonably necessary for legal, regulatory, payment-processing, security, sanctions, or operational reasons.

5.5.

Nothing in these Terms excludes mandatory rights or protections granted to a Customer under applicable law where such rights cannot lawfully be excluded by contract.

6. MEMBERSHIPS AND ACCESS

6.1.

The price, duration and scope of a Membership will be stated at or before purchase.

6.2.

Unless expressly stated otherwise at the time of purchase, purchasing a Membership does not guarantee:

• a minimum number of tips per day;

• tips for any particular sport, league, match, tournament or competition;

• any particular odds;

• tips at a particular time of day;

• continuous availability of specific betting markets;

• profitable results.

6.3.

The volume and nature of content may vary depending on sporting schedules, available betting markets, analyst assessments and other circumstances.

6.4.

Membership access is personal to the Customer and may not be transferred, sold, shared or sublicensed without prior written permission from Footiepredictions.

6.5.

Unless expressly stated otherwise during checkout, a fixed-term Membership expires at the end of the purchased period.

Where a Membership automatically renews, this will be disclosed to the Customer before purchase together with the applicable price and cancellation conditions.

7. ODDS, MARKETS AND BETTING INFORMATION

7.1.

Odds displayed or communicated by Footiepredictions are indicative and may change at any time.

7.2.

Footiepredictions cannot guarantee that a Customer will receive the same odds displayed in our content.

Odds may vary between:

• countries;

• Bookmakers;

• accounts;

• currencies;

• customers;

• times of placement;

• market conditions.

7.3.

A Bookmaker may independently:

• change odds;

• suspend or remove a market;

• refuse a wager;

• limit a Customer’s stake;

• restrict or close an account;

• void a wager;

• apply different settlement rules;

• impose geographical restrictions.

Footiepredictions has no control over these decisions and accepts no responsibility for them except where liability cannot lawfully be excluded.

7.4.

Customers are responsible for checking the selection, odds, market, stake, event, player and other relevant details before confirming any wager.

8. PAYMENTS

8.1.

Customers must use payment methods or payment links officially provided or authorized by Footiepredictions.

8.2.

Prices and applicable currencies will be displayed at or before checkout.

Additional currency conversion charges, banking charges or payment-provider fees may be imposed independently by the Customer’s bank or payment provider.

8.3.

Where taxes are legally required to be charged by Footiepredictions, they may be included in or added to the purchase price as required by applicable law.

8.4.

Access may be withheld until payment has been successfully received or confirmed.

9. UNAUTHORIZED AND PRIVATE PAYMENTS

9.1.

Customers should not make payments to personal bank accounts, cryptocurrency wallets, third parties, social-media accounts or other destinations unless the payment method has been expressly authorized by Footiepredictions.

9.2.

Footiepredictions is not responsible for payments voluntarily sent to fraudulent impersonators, unauthorized third parties, fake accounts, or payment destinations that have not been officially authorized by Footiepredictions, except to the extent responsibility cannot lawfully be excluded.

9.3.

Customers should contact Footiepredictions through an official communication channel if they are uncertain whether a payment request is genuine.

10. REFUNDS AND CANCELLATIONS

10.1.

Except where a refund, price reduction, cancellation, withdrawal right, or other remedy is required under mandatory applicable law, purchases are non-refundable once access to the purchased Service has been provided or performance has commenced.

10.2.

A Customer is not entitled to a refund merely because:

• a prediction or tip loses;

• expected profit is not achieved;

• betting odds change;

• a Bookmaker refuses or limits a wager;

• the Customer does not use the Service;

• the Customer disagrees with an analysis;

• a sporting event is postponed, cancelled or changed;

• fewer suitable betting opportunities are identified than the Customer expected.

10.3.

Nothing in this section affects statutory remedies that cannot lawfully be waived.

10.4.

Customers experiencing a genuine problem with access or delivery should contact Footiepredictions so that the issue can be investigated.

11. CONSUMER WITHDRAWAL RIGHTS

11.1.

Where applicable law provides the Customer with a statutory withdrawal or cooling-off period, Footiepredictions will respect that right in accordance with applicable mandatory law.

11.2.

Where legally permitted, Customers may be offered immediate access to digital content or immediate commencement of digital Services during a statutory withdrawal period.

Where applicable law requires it, immediate performance and any resulting loss or limitation of the withdrawal right will be subject to the Customer’s prior express consent, acknowledgement and any required confirmation.

11.3.

Accepting these Terms alone shall not be treated as replacing any separate express consent or acknowledgement required by mandatory consumer law.

12. CHARGEBACKS AND PAYMENT DISPUTES

12.1.

Customers who believe that a payment has been processed incorrectly or that the Service has not been supplied as agreed are encouraged to contact Footiepredictions before initiating a payment dispute.

12.2.

Footiepredictions reserves the right to contest chargebacks or payment disputes that we reasonably believe are fraudulent, misleading, abusive or inconsistent with the Service actually provided.

12.3.

Where legally permitted, access to the Services may be suspended while a payment dispute relating to that access remains unresolved.

12.4.

Nothing in this section prevents a Customer from exercising any payment-dispute or consumer rights that cannot lawfully be restricted.

13. INTELLECTUAL PROPERTY

13.1.

All original analyses, written explanations, betting selections, graphics, videos, databases, compilations, formats, branding, private-channel content and other materials created by Footiepredictions remain the intellectual property of Footiepredictions or its applicable licensors.

13.2.

Purchasing a Membership grants the Customer a limited, personal, non-exclusive, non-transferable right to access the relevant content for personal use.

No ownership rights are transferred to the Customer.

14. PROHIBITED SHARING AND COMMERCIAL USE

14.1.

Without prior written permission from Footiepredictions, Customers may not:

• resell paid content;

• redistribute private content;

• forward tips to non-members;

• publish private-channel content;

• systematically screenshot or record private content for redistribution;

• operate a competing service using Footiepredictions content;

• reproduce or commercially exploit Footiepredictions analyses;

• provide third parties with unauthorized access to private groups.

14.2.

Footiepredictions may immediately suspend or terminate access where there is reasonable evidence of unauthorized distribution, resale, account sharing or commercial exploitation.

14.3.

Footiepredictions reserves the right to pursue damages, injunctive relief and other remedies available under applicable law for unauthorized exploitation of its intellectual property.

15. CONTRACTUAL PENALTY FOR UNAUTHORIZED DISTRIBUTION

15.1.

Where permitted by applicable law, intentional commercial resale, systematic redistribution, or unauthorized publication of paid Footiepredictions content may result in a contractual penalty of €3,000 per established violation and €300 for each subsequent calendar day that the established violation continues after written notice.

15.2.

Any contractual penalty shall apply only to the extent enforceable under applicable law and shall not prevent a competent court from exercising any power it has under mandatory law to review or adjust such penalty.

15.3.

To the extent permitted by applicable law, Footiepredictions reserves the right to claim proven damages exceeding the applicable contractual penalty where such additional recovery is legally available.

16. MARKETING AND HISTORICAL RESULTS

16.1.

Footiepredictions may publish historical results, screenshots, betting slips, previous predictions, statistical summaries, member experiences or other examples for informational or promotional purposes.

16.2.

Historical performance does not guarantee future performance.

16.3.

Unless expressly stated otherwise, individual screenshots or examples should not be interpreted as representing every prediction, every Member’s experience, or guaranteed typical results.

16.4.

Where performance statistics are presented as an aggregate or defined performance period, Footiepredictions will endeavour to present them accurately based on the methodology stated with or applicable to that material.

17. THIRD-PARTY PLATFORMS

17.1.

The Services may depend on third-party services such as Telegram, Instagram, websites, hosting providers, payment processors, email providers and other technology providers.

17.2.

Footiepredictions does not control those third-party services and cannot guarantee their uninterrupted availability.

17.3.

Temporary loss of access caused by a third-party outage, platform restriction, network failure or other event outside Footiepredictions’ reasonable control does not automatically entitle the Customer to a refund.

17.4.

Where a significant interruption prevents Footiepredictions from providing a material part of a paid Service, Footiepredictions may, where appropriate and subject to applicable law, provide replacement access, an extension, alternative delivery, credit or another reasonable remedy.

18. SERVICE CHANGES

18.1.

Footiepredictions may make reasonable changes to the way the Services are delivered, including changing communication platforms, channel structures, formats, analysts, posting schedules or technical systems.

18.2.

Such changes will not intentionally deprive Customers of the essential Service they purchased.

18.3.

Material changes affecting an ongoing paid Membership will be handled in accordance with applicable mandatory law.

19. SUSPENSION AND TERMINATION

19.1.

Footiepredictions may suspend or terminate a Customer’s access where the Customer:

• materially breaches these Terms;

• shares or resells private content without authorization;

• attempts to gain unauthorized access;

• commits payment fraud;

• impersonates Footiepredictions;

• engages in harassment or credible threats;

• engages in extortion or blackmail;

• intentionally disrupts private communities;

• uses the Services for unlawful purposes.

19.2.

Where reasonably appropriate, Footiepredictions may provide the Customer with an opportunity to remedy a breach before termination.

Immediate suspension or termination may occur where the breach is serious, fraudulent, threatening, unlawful, or creates an immediate risk to Footiepredictions or other Customers.

19.3.

Any refund following termination will be determined in accordance with these Terms and applicable mandatory law.

19.4.

Footiepredictions may report suspected criminal conduct to the appropriate authorities.

20. CUSTOMER CONDUCT

Customers must not use Footiepredictions platforms or communities to engage in:

• threats or intimidation;

• harassment;

• unlawful discrimination;

• extortion or blackmail;

• fraud;

• impersonation;

• malware distribution;

• unauthorized advertising or spam;

• unlawful publication of personal information;

• conduct that materially interferes with other Customers’ use of the Service.

Footiepredictions may moderate its communities and take reasonable measures to protect its staff, contractors and Customers.

21. RESPONSIBLE GAMBLING

21.1.

Betting involves financial risk and should only be undertaken with money that the Customer can afford to lose.

21.2.

Footiepredictions does not encourage Customers to chase losses, borrow money to gamble, or treat sports betting as guaranteed income.

21.3.

Customers experiencing loss of control, financial distress or compulsive gambling behaviour should stop betting and seek assistance from an appropriate responsible-gambling organization in their jurisdiction.

21.4.

Footiepredictions may refuse or terminate access where required by applicable law or where continued access would conflict with legal or regulatory obligations.

22. LIMITATION OF LIABILITY

22.1.

To the maximum extent permitted by applicable law, Footiepredictions shall not be liable for losses arising solely from a Customer’s independent decision to place a wager based on information contained in the Services.

This includes, where legally permitted:

• lost betting stakes;

• gambling losses;

• missed profits;

• differences in available odds;

• unavailable betting markets;

• Bookmaker account restrictions;

• Bookmaker settlement decisions;

• incorrect entry of a wager by the Customer.

22.2.

Footiepredictions does not accept liability for indirect or consequential losses to the extent such liability may lawfully be excluded.

22.3.

To the extent permitted by applicable law, where Footiepredictions is liable for damages arising from a specific paid Service, aggregate contractual liability shall be limited to the amount paid by the Customer for the affected Service during the three months immediately preceding the event giving rise to the claim.

22.4.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by mandatory law, including liability that cannot lawfully be excluded for intentional misconduct.

23. ERRORS AND CORRECTIONS

23.1.

Although Footiepredictions aims to provide accurate information, human or technical errors may occur.

Examples include:

• incorrect odds;

• incorrect player names;

• typographical errors;

• incorrect kickoff times;

• duplicate messages;

• incorrect market descriptions;

• outdated information.

23.2.

Footiepredictions may correct or clarify content after publication.

23.3.

Customers remain responsible for checking the details displayed by their Bookmaker before placing a wager.

24. FORCE MAJEURE

Footiepredictions shall not be responsible for delays or failures caused by circumstances reasonably beyond its control, including:

• internet outages;

• hosting failures;

• cyber incidents;

• telecommunications failures;

• failures of third-party platforms;

• natural disasters;

• war or civil disturbance;

• government restrictions;

• widespread power failures;

• strikes;

• regulatory intervention;

• major sporting-event cancellations.

This provision applies only to the extent permitted by applicable law.

25. PRIVACY AND PERSONAL DATA

Personal data will be processed in accordance with applicable data-protection law and the Footiepredictions Privacy Policy.

Where applicable, Customers should review the Privacy Policy before purchasing or using the Services.

26. COMMUNICATIONS

26.1.

Footiepredictions may communicate with Customers through email, Telegram, website notifications, social-media platforms or other contact methods provided by the Customer.

26.2.

Customers are responsible for providing accurate contact information and maintaining access to the relevant communication channels.

26.3.

Footiepredictions is not responsible for a Customer’s failure to receive communications because of incorrect contact information, spam filters, notification settings, blocked accounts or circumstances outside our reasonable control.

27. COMPLAINTS

Customers who have a complaint concerning a payment, Membership or Service should first contact Footiepredictions through the official contact details published on our website.

Customers should provide sufficient information for the complaint to be investigated, including the relevant purchase information and a description of the issue.

Nothing in this section prevents a Customer from exercising statutory dispute-resolution or consumer rights available under applicable law.

28. CHANGES TO THESE TERMS

28.1.

Footiepredictions may update these Terms from time to time for legal, regulatory, security, operational or commercial reasons.

28.2.

The Terms applicable at the time an individual purchase is concluded generally govern that purchase, unless applicable law or the Agreement permits subsequent changes.

28.3.

For ongoing Services, material changes will be communicated where required by applicable law.

29. SEVERABILITY

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision shall be interpreted or limited to the minimum extent necessary where legally possible.

The remaining provisions shall continue in effect.

30. NO WAIVER

A failure or delay by Footiepredictions in enforcing any contractual right does not automatically constitute a waiver of that right.

31. ENTIRE AGREEMENT

These Terms, together with the information presented during checkout and any policies expressly incorporated into the Agreement, constitute the contractual terms governing the purchased Service.

Any individual written agreement expressly entered into between Footiepredictions and the Customer shall prevail over these Terms to the extent of a direct conflict.

32. GOVERNING LAW

32.1.

These Terms and Agreements with Footiepredictions shall be governed by the laws of the Netherlands.

32.2.

For consumers, this choice of law does not deprive the Customer of mandatory consumer protections applicable under rules of private international law that cannot contractually be excluded.

33. JURISDICTION

33.1.

To the extent legally permitted, disputes relating to the Agreement shall be submitted to the competent courts in the Netherlands.

33.2.

Where mandatory consumer or jurisdictional law gives a Customer the right to bring proceedings before another competent court, nothing in these Terms removes that right.

35. ACCEPTANCE

By purchasing a Membership or otherwise entering into an Agreement with Footiepredictions, the Customer confirms that they have had the opportunity to read these Terms before completing the purchase.

Where separate consent is required by applicable law — including consent relating to immediate performance of digital content or Services and statutory withdrawal rights — Footiepredictions may request that consent separately during checkout.
